(Thread Starter) | Not Ranked : 0 score Been hunting around for the specific info that I need, but apparently this isn't a common problem. I woke up early this morning, and my MS6 was completely missing from my parking lot. I quickly realized it had been towed away. Over night, the towing company came sniffing around our complex looking for visitors parked in resident spaces. A permit is required to be displayed in your window to park in resident spaces. They see my MS6 parked in a resident space, and they decide to snatch it, and they tow it 15 miles down the interstate to their shabby dirt lot. The dispatcher told me the car stayed there for 2 hours, so at some point they noticed my permit, and decided to tow my MS6 the 15 miles back and drop it on the other side of the complex. When I asked for specific information on the type of truck they used, I was told that all 4 wheels were lifted with dollys. Obviously I don't trust dumb fucks who tow away cars before looking for permits, and I didn't see any of this go down, so they may have damaged the car. So my question is, what signs can I look for to indicate they either did or did not damage my MS6?

| Not Ranked : 0 score I'd file a police report immediately either way so it's on record that way you have recourse if something did happen (otherwise you're going to be SOL). I'd probably start by draining the PTO and rear diff fluids, see if you have any metal in them etc. If you do save them, send some out to blackstone for lab testing (just for 3rd party proof). You probably won't know there's damage unless you drive it to see.

(Thread Starter) | Not Ranked : 0 score Still haven't driven the car other than the few hundred feet back to my building. Seems that since the state licenses the towers, they are pretty much immune from criminal charges -- the police will not take a report. if this goes to court it will be a civil proceeding, so if anyone has any more tips on what signs indicate damage or the lack thereof, lemme hear it, i don't want to drive the car until I know what to look for.

| Not Ranked : 0 score Well, here's what I would do then, just because the state licenses them doesn't mean they're immune for anything. They are NOT the state, they merely have a licensed issue allowing them to do that for business within the CORRECT jurisdiction where allowed. They obviously were outside of this when they towed it without proper verification. If the police will not give you a police report (which I call bullshit, they don't want to). I would immediately contact the state attorney general, report which officer you spoke with on the phone. Include you tried to get a police report due to potential damages due to NEGLIGENCE of the towing party to properly verify the vehicle was able to be towed. That at least gets it on the books, and throws the lazy cops under the bus. If you really want to go after them, you'll need a lawyer if the state attorney general won't help. I already told you what you need to do to check for damage, not much you can do outside of that I believe TBH.

the "juridstiction" is simply a covenant with the owners of the property that you a "legally allowed guest" on in that anything OUTSIDE your apt is their property and they can have any car towed. somewhere in your rental agreement you get relieved of that for 1 car, in your assigned spot. from my point of view, You're going to have to get the owners of the complex written into the complaint, since the tow company was operating under contract and at the behest of the complex. And you're going to have to claim some tangible damages, denial of use of property can tag along, but its a weak lead. gotta be a scratch on there somewhere. if its in a spot, with cars on either side, I think they drag out, then dolly Good luck Pu same thing happed to my kid, parked in front of my ex's driveway. busted up the fiberglass body kit, and got away with it

| Not Ranked : 0 score They illegally towed the car, they covenant states in conditions "x,y,z" they admitted to him they violated that and noticed he had a tag that meant it was parked LEGALLY per their by-laws. It's not the complex's fault they failed to follow instructions, they're 100% liable for damages (as you mentioned yes must be tangible). I'd still file a complaint with the state attorney general, take it from the guy who has prosecuted 6 companies this way (including insurance companies) when they tried to fuck me in various accounts.

(Thread Starter) | Not Ranked : 0 score when i investigated the first incident, there was no record, so I had no proof that anything happened. the towing company noticed their error quickly... they did not notify the police, they did not notify property management (the contract mandates a picture emailed to the property manager), they returned the car to the lot before I noticed it missing, and there are no surveillance cameras in our parking lots. this time the towing company fucked themselves by notifying police, the property, and keeping the car on their lot. they noticed their error too late this time. Initially they offered to let me pick the car up for free, but after speaking to the property manager this morning the co-owner of the towing company agreed to tow the car back to the property for free. when the co-owner showed up with my car, I confronted him in a recorded conversation. the co-owner of the towing company still accused me of violating the parking agreement, saying that my permit is invisible. the co-owner stated that the next time he tows my car, it's not coming back for free, so now I'm pretty pissed. all the details of the permit have been double-checked, and no one else who has looked at the permit has agreed with his assertion. my property manager has been a huge ally so far. I found out another fully compliant resident was towed labor day weekend, but he could not reach property management over the holiday weekend, so he actually paid the towing company to get his car back. the property is in the process of trying to credit that resident over $190 in towing and storage fees. I believe the towing company has committed at least two violations of the law in my case alone, so I will file a detailed complaint with the state regulators, fines are $3,900-$13,600. as far as the property, the property manager's hands are tied as far as the towing contract, so I will appeal to regional property management to dump their contract with these malicious criminal fucks. I never thought this shit could happen, and I hope no one else gets clipped with this kind of bullshit.
