muffler ticket

I have the cp-e nexus exhaust and last night a cop followed me 2 miles then pulled me over.
the nice lady officer said I had a defective muffler because it was too loud.
I asked if she had a decibel tester, she did not.
she said anything other than stock is illegal, bs.

so I get a ticket for a defective muffler.

im wondering if a judge would even look at pictures of my awesome stainless muffler.

More than likely not, depending on how strict your state and county is if you show pictures of the modified exhaust you'd be doing yourself a disservice. It's your word vs there's and it sucks. I got a ticket back in 07' the cop openly admitted he couldn't see me when I drove by, but estimated my speed at 75 in a 45 by the sound of my vehicle and how loud it was....

In MD the law is you cannot modify an exhaust to be louder than stock.

Most of the time it's just a repair ticket so you just have to a shop to sign off saying its a full system with no holes.

Is there a fine with yours ?

Actually in NJ, anything other than stock IS illegal. However that doesn't stop me from going single exit haha. Down here in South Jersey, its really Winslow, Waterford and Merchantville that are the most strict with it. Most other departments don't seem to care.

I see 4x4s with 4 to 5" pipes sticking strait up out of the beds everywhere, plus tons of loud mustangs and camaros.

just sux, I really don't think its that loud, unless full throttle.

Cop tried to do this to me the other day, it was hilarious. I drove by a small street where I guess a cop was hiding. I think he heard my exhaust while I was shifting from 3500 and thought I was speeding. When I passed that street all I saw behind me was the guy fishtailing out of a nowhere with his lights and sirens blazing. He quickly realized I was driving slow and turned his lights and siren off. He then proceeded to pass me acting like nothing happened but got caught by a red light. I pulled up next to him and asked if there was a problem with a big smile on my face. He didn't even look at me I think he was very embarrassed.

a buddy of mine had a 240 (sr20 swap) with a pretty loud exhaust and a lady cop pulled him over and said he didn't have a muffler. he said "did you look at the back? there is obviously a muffler there". he had to take it to a shop anyway. you'd think that if an LEO had any doubt about a specific law, they'd leave it alone. It sucks that there are so many beaten and riced hondas that are way fucking louder than any of our exhausts that are in decent condition. I got pulled over once for revving waaayyyy high because some bitch behind me was trying to sneak around me and almost got me stuck in the middle of a main road. Horn was out so that and giving the finger was my way of telling her to fuck off. Cop saw me and decided to get me for a license plate obstruction. Corksport plate frame covered the "garden state" and "New Jersey" wording and got a 58$ ticket. I guess I got off pretty lucky overall.

Muffler tickets are dumb, but w/e. I got a ticket a few months back when I had my gen1. Catless DP/TP, and CBE w/resonator delete. Yeah it was stupidly loud, but when I got the ticket I was shifting at like 2k rpm to try to keep it quiet as the fuck face followed me. Either way, I deserved it, paid it off and went off my way.

NJ has no restrictions on motorcycle exhaust, any emissions level any db level is legal.

In a lot of states it is illegal to make any type of modification to your exhaust. Even without a decibel meter, it doesn't take a rocket scientist to know if an exhaust system has been modified. I know in Philly, I don't need a decibel meter. I can give you a ticket if I suspect any exhaust modifications. It's your job to prove otherwise in court. I've never once given the ticket and I don't think many cops, other than traffic will give it in Philadelphia either.

the city, county, or state law enforcement test for the db level.
The Iowa dept of trans advised me to go to the private sector for testing.
So Thursday I have a test set up with an audio company that does all the local decibel drags, stereo competitions.

Couldn't the OP try and reference the Magnuson-Moss Warranty Act of 1975, which allows for aftermarket parts in place of OE parts? I realize its more of a dealership denying warranty coverage, but the ticket refers to "stock exhaust", go with the " the original got a hole in it" route. As a Philly cop - if its like the Hunting Park Corolla Club and ricer soup can mufflers - that should require deadly force anyway!

This is a misstatement of the law. Burden of proof is on the prosecution. Innocent until proven guilty applies in traffic court too. Now, whether or not you end up with a shitty judge who takes the cop's word as sufficient proof is another matter. I beat an illegal lane change ticket (for not signaling before changing lanes) last year when the only evidence against me was the cop's testimony - I just argued that I had used my blinker. There was no dashcam video to corroborate the cop's testimony, so it was my word vs his. Ticket got thrown out.

To my understanding, the Magnuson warranty act is used for civil cases, not criminal.

I had a magnaflow on my last car (v6 mazda6) and got a ticket for the exhaust even though it was quieter than my ms3 stock exhaust. i was told anything other than stock is illegal. I got it dropped just by showing up at court. sheriff wouldnt have even known i had it if it wasnt shiny. this guy was a dick tho, he gave me a total of 9 tickets: exhaust, front doors window tint, back doors window tint, eyebrow tint below the line on the windshield, tinted turn signals, tinted reverse lights, tinted stop lamps, no front plate, and tinted license plate cover. ended up getting everything dropped after i took my window tint off and sanded the tint off my tail lights. then i got darker tint put on windows.
